A journalist filed an access to information request with the First Basic Public Prosecutor (hereinafter: Prosecutor) pertaining to the public authority’s file on investigating the Mayor of Belgrade who, according to Anti-corruption Agency that filed criminal charges against the Mayor to the public authority, failed to report information on property and allegedly provided false information.
 

The Prosecutor denied access to information based on the exemption that allowing access to information would jeopardise indictment of a criminal offence, pretrial proceedings, or unbiased treatment and a fair trial, since the Mayor submitted all information during the processing of Anti-corruption Agency’s charges, while the Prosecutor decided to defer criminal prosecution and the Mayor paid the requested sum to the benefit of humanitarian purposes, as provided for by Criminal Procedure Code. The prosecutor added that access to its decision to reject the criminal charges filed by Anti-corruption Agency, could jeopardise possible criminal procedure.

2.    Decision

In his decision Commissioner noted the public interest to know the reasoning behind the Prosecutor’s decision to reject criminal charges filed by a public authority in its legal capacity against a public, and important political, figure. The case was intensely reported in the media. With regard to the notion of possible criminal procedure the Commissioner rejected the argument as the exemption could refer to an ongoing procedure and not hypothetical one. The Commissioner concluded that the Prosecutor failed to show that allowing access to information would cause legal or other harms to legitimate interests, without prejudice to any future investigation following the knowledge of new facts.

Decision:  
La Corte Suprema de Justicia ordenó al Estado Nacional -Ministerio de Desarrollo Social- brindar la información íntegra requerida por la ONG -CIPPEC-, referida a planes sociales de asistencia a la comunidad que el Ministerio demandado administra. Así, y en atención a lo resuelto por el Tribunal, el Ministerio de Desarrollo Social de la Nación deberá dar a conocer el modo en que ejecuta el presupuesto público asignado por el Congreso de la Nación específicamente respecto de estos programas.

La mencionada ONG había requerido que se le informara: 1) padrones de beneficiarios de transferencia limitada y/o subsidios otorgados en concepto de “ayuda social a personas” durante 2006 y 2007; 2) transferencias a “Otras instituciones Culturales y Sociales sin Fines de Lucro” sean estas organizaciones locales, instituciones comunitarias o asociaciones barriales, identificando individualmente el nombre de la organización receptora, programa bajo el cual recibe el subsidio y valor monetario de cada una de las transferencias realizadas en el año 2006 y 2007.
 
Además, había solicitado información sobre el alcance territorial y los funcionarios públicos de nivel nacional, provincial o local y representantes de organizaciones políticas, sociales o sindicales que intervengan en algún momento del proceso de la entrega de las prestaciones y de los intermediarios que otorgan los planes (municipios, organizaciones sociales, etc.).


2.    Decision

En el fallo se sostiene que el fundamento central del acceso a la información en poder del Estado consiste en el derecho que tiene toda persona de conocer la manera en que sus gobernantes y funcionarios públicos se desempeñan. La Corte afirmó que la información pertenece a las personas, no es propiedad del Estado y el acceso a ella no se debe a una gracia o favor del gobierno. Este tiene la información solo en cuanto representante de los individuos. El Estado y las instituciones públicas están comprometidos a respetar y garantizar el acceso a la información a todas las personas. Asimismo, se afirmó que el Estado está en la obligación de promover una cultura de transparencia en la sociedad y en el sector público, de actuar con la debida diligencia en la promoción del acceso a la información, de identificar a quienes deben proveer la información, y de prevenir los actos que lo nieguen y sancionar a sus infractores.

También el tribunal concluyó que cuando se trata de información pública el Estado Nacional está obligado a permitir a cualquier persona acceder a ella en tanto no se refiera a datos “sensibles” cuya publicidad constituya una vulneración del derecho a la intimidad y al honor. También se subrayó que, según la ley, los “datos sensibles” son los que revelan el origen racial o étnico, las opiniones políticas, convicciones religiosas, filosóficas o morales, afiliación sindical e información referente a la salud o a la vida sexual de las personas. En razón de ello, se destacó que atento que la información reclamada por CIPPEC no se refería a ninguno de los aspectos señalados, no podía ser calificada como “sensible” . En consecuencia, se concluyó que la negativa del Estado Nacional a acceder a lo solicitado por la actora carecía de sustento legal y las razones brindadas para fundar esa decisión aparecían como meras excusas para obstruir el acceso a la información. En este contexto, se señaló que debe prevalecer el principio de máxima divulgación de la información pública.
 

Así, se entendió que los datos solicitados, debidamente evaluados por CIPPEC, constituyen una herramienta fundamental para que el pulso vivo y crítico de la esfera pública contribuya a determinar si la instrumentación de las políticas sociales establecidas por el Estado contribuye efectivamente o es disfuncional a los fines perseguidos.

La Corte Suprema de Justicia de la Nación ordenó al Instituto Nacional de Servicios Sociales para Jubilados y Pensionados –PAMI- a brindar información relativa a su presupuesto del 2009 de publicidad oficial, así como su distribución en mayo y junio de ese año, que había sido requerida por la Asociación por los Derechos Civiles (ADC).

La ONG Asociación por los Derechos Civiles (ADC) promovió acción de amparo contra el Instituto Nacional de Servi­cios Sociales para Jubilados y Pensionados (PAMI)con el objeto de que se hiciera entrega de”…la información relativa al presupuesto en concepto de publicidad oficial de dicho organismo para el año 2009 y a la inversión publicitaria de dicha institución correspondiente a los meses de mayo y junio de 2009 detallada según el rubro (medios gráficos, radiales, televisivos, cinematográficos, sitios de internet y vía pública) y medio de comuni­cación, productora o programa al cual fue asignada. 
 
 

2.    Decision
El Máximo Tribunal –con la firma de todos sus ministros- rechazó un recurso extraordinario que había presentado el PAMI contra un fallo de la Cámara Nacional en lo Contencioso Administrativo Federal que hizo lugar a la acción de amparo iniciada por la ONG. 

En el caso, el PAMI había apoyado su rechazo a brindar la información requerida al entender que el decreto 1172/03, que regula el acceso a la información pública, no les es aplicable pues se refiere a las instituciones que forman parte del Estado, lo que no es su caso, a partir de que posee personalidad jurídica e individualidad financiera legalmente diferenciada de este último.
Según el fallo del Alto Tribunal, el alcance dado a la legislación federal que menciona el fallo de Cámara para exigir al PAMI que brinde la documentación solicitada por la asociación “resulta razonable y deriva del derecho de acceso a la información pública que tiene todo ciudadano de conformidad con los artículos 1, 14, 16, 31, 32, 33 y art. 75, inciso 22, de la Constitución Nacional”.
Asimismo, dijo que idéntico razonamiento merece el alcance supletorio del decreto 1172/03 con respecto al PAMI, “con fundamento en la naturaleza jurídica de la institución y relevancia de los intereses públicos gestionados y en la indudable interrelación de este último con el Estado Nacional”.

“Aun cuando el recurrente no posea naturaleza estatal, dadas sus especiales características y los importantes y trascendentes intereses públicos involucrados, la negativa a brindar la información requerida constituye un acto arbitrario e ilegítimo en el marco de los principios de una sociedad democrática e implica, en consecuencia, una acción que recorta en forma severa derechos que son reservados –como se verá- a cualquier ciudadano, en tanto se trata de datos de indudable interés público y que hagan a la transparencia y a la publicidad de gestión de gobierno, pilares fundamentales de una sociedad que se precie de ser democrática”, aseguró la Corte Suprema. En cuanto a la legitimación pasiva, en base a lo expresado por la Corte Interamericana de Derechos Humanos, “para que los Estados cumplan con su obligación general de adecuar su ordenamiento interno con la Convención Americana en este sentido, no sólo deben garantizar este derecho en el ámbito puramente administrativo o de instituciones ligadas al Poder Ejecutivo, sino a todos los órganos del poder público”.
 
“Dicha amplitud supone incluir como sujetos obligados no solamente a los órganos públicos estatales, en todas sus ramas y niveles, locales o nacionales, sino también a empresas del Estado, hospitales, las instituciones privadas o de otra índole que actúan con capacidad estatal o ejercen funciones públicas”, añadió.
